THE PRESENTER : Christo Smith is the author of the LexisNexis loose-leaf publication Eviction & Rental Claims : A Practical Guide. The book is regularly updated and now includes a new comprehensive section on the effect and application of the CPA on leases. Christo is a practising attorney with 26 years experience and has presented seminars countrywide on behalf of LEAD as well as privately for a number of years. He is an expert in the field of evictions and rental claims and litigates extensively in this field of the law.

Eviction & Rental claims
This morning seminar deals with all evictions - from the first consultation to the final order. Hints are provided how to speed up the process and distinguish between the different kinds of evictions, i.e Pie, Esta and common law. The latest developments in procedures and case law are discussed. The seminar is practical and aimed at clerks as well as seasoned practitioners who need to acquaint themselves with the basics. Special attention is given to drafting aspects and procedure. In addition the practical aspects of Eviction law, the effect of attachment procedures of immovable property, rescissions of judgments and the setting aside of transfers, are dealt with.

Magistrate's Court Procedure
This is a morning seminar that deals with procedure in the Magistrate's Court. Attorneys, and especially clerks who need to get up to speed with appearance in die Magistrate's Court as well as the new rules, will benefit from this seminar.
Apart from the procedural aspects, attention will also be given to the most common causes of action and motions to equip clerks with the basic skills for purposes of appearance.
Procedures such as drafting of pleadings in motor collision cases, spoliation, enrichment claims, damages and evictions, will be discussed.

The CPA : sales & leases
This is a morning seminar dealing with the full spectrum of application of the Consumer Protecton Act on sales and leases of immovable property. The following will be dealt with :
- the application of the CPA on sales and leases,
-when purchasers may cancel,
- hints on drafting agreements,
- setting aside of transfers,
- voetsoots clauses and unfair contract terms.
Practical hints are given on how to avoid the adverse consequences of the Act and how to limit a landlord's liability for negligent acts.
